§ 32611. Employee Organization Unfair Practices Under Ihsseera.

  • It shall be an unfair practice for an employee organization to do any of the following:
    (a) Cause or attempt to cause the Statewide Authority to engage in conduct prohibited by IHSSEERA.
    (b) Interfere with, intimidate, restrain, coerce or discriminate against employees because of their exercise of rights guaranteed to them by IHSSEERA.
    (c) Refuse or fail to meet and confer in good faith as required by IHSSEERA.
    (d) Fail to exercise good faith while participating in any impasse procedure required by IHSSEERA.
    (e) In any other way violate IHSSEERA or any rule or regulation adopted pursuant to Government Code section 110035.
HISTORY
1. New section filed 12-6-2013 as an emergency; operative 12-6-2013 pursuant to Government Code section 110035.5 (Register 2013, No. 51). This regulatory action is deemed an emergency exempt from OAL review and was filed directly by the agency with the Secretary of State pursuant to Government Code section 110035.5. A Certificate of Compliance must be transmitted to OAL by 6-4-2014 or emergency language will be repealed by operation of law on the following day.
