§ 10003. Liberal Construction of Complaints.

- The department shall liberally construe all complaints to effectuate the purpose of the laws the department enforces to safeguard the civil right of all persons to seek, obtain and hold employment without discrimination. Where the facts alleged in a discrimination complaint support a claim of retaliation, harassment, or any other claim over which the department has jurisdiction, the department shall construe the complaint to include those claims within the scope of a discrimination claim, regardless of whether such other claims are expressly stated. Likewise, where the facts alleged in a harassment complaint support a claim of discrimination, retaliation, or any other claim over which the department has jurisdiction, the department shall construe the complaint to include those claims within the scope of the harassment claim, regardless of whether such other claims are expressly stated.HISTORY1.
