§ 69507. Dispute Resolution.

- (a) Applicability. This article applies to any responsible entity that wishes to dispute a decision made by the Department under this chapter that applies to the responsible entity, except as otherwise provided in subsection (c).(b) Exhaustion of Administrative Remedies. The procedures set out in this article are required for resolving disputes arising under this chapter. If the responsible entity fails to follow the procedures specified in this article for disputes subject to this article, it waives its right to further contest the disputed issue.(c) Scope. Notwithstanding any other provision of this chapter, a decision made by the Department under article 2, 4, or 9 is not subject to dispute resolution under this article.(d) Automatic Stay. A requirement imposed by the Department under this chapter on a responsible entity, and any posting concerning the requirement on the Failure to Comply List, is stayed during the pendency of an administrative dispute concerning the requirement.HISTORY1.
