§ 66266.101. Management Prior to Burning.

- (a) Generators. Generators of hazardous waste that is burned in a boiler or industrial furnace are subject to the applicable provisions of chapter 12, of this division.(b) Transporters. Transporters of hazardous waste that is burned in a boiler or industrial furnace are subject to the applicable provisions of chapter 13, of this division.(c) Storage Facilities. (1) Owners and operators of facilities that store hazardous waste that is burned in a boiler or industrial furnace are subject to the applicable provisions of chapters 14, 15 and 20, of this division, except as provided by subsection (c)(2) of this section. These standards apply to storage by the burner as well as to storage facilities operated by intermediaries (processors, blenders, distributors, etc.) between the generator and the burner.(2) Owners and operators of facilities that are exempt under the provisions of section 66266.108 and that store mixtures of hazardous waste and a primary fuel in tanks that feed the hazardous waste/fuel mixture directly to the burner, are exempt (with respect to the aforementioned hazardous waste/fuel mixture) from the storage provisions of chapters 14, 15 and 20, of this division. Storage of hazardous waste prior to mixing with a primary fuel is subject to the regulation as prescribed in subsection (c)(1) of this section.HISTORY1.
