§ 53852. Availability of Services.

- Each plan in a designated region shall obtain written departmental approval prior to making any substantial change in the availability or location of services to be provided under the contract, except in the case of a natural disaster or emergency circumstances. A proposal to change the physical location at which covered services are provided, or to reduce or change the hours, days or location at which the services are available, shall be given to the department at least sixty days prior to the proposed effective date. The department's denial of the proposal shall prohibit implementation of the proposed changes. The plan's proposal shall allow for timely notice to beneficiaries to allow them to change plans if desired.HISTORY1. New section filed 7-1-96 as an emergency; operative 7-1-96.
