§ 50518. Fluctuating Income.

- (a) Fluctuating income shall be determined by estimating the amount to be received in the month unless the conditions of (b) are met. This estimate shall be made considering all of the following:(1) The income pattern over the last year.(2) The actual income received in the last month.(3) The beneficiary's statement of anticipated income.(b) Actual income shall be used if it is known at the time the share of cost determination is being made. In no instance shall the share of cost determination be delayed solely to determine the actual income.(c) The provisions of this section shall not apply to income from self-employment which shall be determined in accordance with Section 50505 and apportioned in accordance with Section 50517(a)(5).HISTORY1.
