§ 1065.35. Civil Suit to Enjoin Violations.

- The department shall initiate a civil suit whenever such suit is necessary to enjoin the violation or threatened violation of chapter 3 (commencing with section 1200) of the Business and Professions Code or the regulations adopted thereunder. A person or entity against whom a civil suit is filed shall have all the rights of defense afforded by California civil law.HISTORY1. A Certificate of Compliance must be transmitted to OAL by 12-26-97 or emergency language will be repealed by operation of law on the following day.2.
